Terms and conditions
These Terms govern the sale, installation and servicing of the Altitude Water atmospheric water generators that Agua del Aire supplies in the Dominican Republic. Read them before purchasing, accepting delivery, or signing a service contract.
1. Who we are, and scope
- The Company
- AGUA DEL AIRE, S.R.L., a limited liability company incorporated and existing under Law 479-08 on Commercial Companies of the Dominican Republic, domiciled in Sosúa, Puerto Plata province. In this document, “the Company”, “we” and “our” refer to Agua del Aire.
- Our position
- Agua del Aire is the authorised Altitude Water distributor in the Dominican Republic. We are not the manufacturer of the Equipment: we import it, sell it, install it, service it locally, and handle warranty claims with the manufacturer on your behalf.
- The Customer
- The natural or legal person (residential buyer, commercial business, or public entity) acquiring or operating the Equipment.
- The Equipment
- The Altitude Water atmospheric water generators, models T-12, T-100 and T-200, supplied by Agua del Aire, together with the accessories and consumables invoiced with them.
- The Services
- Delivery, installation, routine maintenance, filter and part replacement, and technical support provided by Agua del Aire.
- Acceptance
- By purchasing the Equipment, accepting delivery of it, or signing a service contract, the Customer agrees to be bound by these Terms as they stand on the date of the transaction.
2. Equipment performance and environmental dependence
- How the water is produced
- The Equipment generates drinking water by extracting moisture from ambient air through condensation, then puts it through multi-stage filtration, mineralisation and purification.
- Output is an estimate, never a guarantee
- The volume any model produces depends directly on the relative humidity and air temperature at the installation site, and varies with the day's weather, the season, and exactly where the unit sits. Agua del Aire does not guarantee a fixed daily output. The range stated in the quotation is a site-specific estimate, calculated from the assessment of the Customer's location; it is neither a performance promise nor an essential condition of the contract.
- Unfavourable conditions
- In locations with sustained low relative humidity, in air-conditioned interiors, or in spaces without air renewal, output falls below the estimate. Agua del Aire will flag that limitation during the pre-installation assessment where it is foreseeable.
- Power supply
- The Equipment requires a stable electrical supply meeting the applicable Dominican standards (110V or 220V depending on the model and its configuration). Damage caused by surges, brownouts, outages or unstable connections, in the absence of an adequate surge protector or voltage regulator, is excluded from the warranty.
3. Maintenance and filters, on the Customer
Maintenance on schedule is what preserves the Equipment's efficiency and the quality of the water to the manufacturer's specifications. The Customer undertakes to observe the intervals in the manual for the unit actually installed, which are as follows.
- Air filter
- Cleaning or replacement every 1 to 4 months, depending on dust and salt air at the site. On the coast and in dusty areas, plan for the short end of that range.
- Water filters
- Replacement every 6 months or every 750 gallons produced, whichever comes first.
- Conforming replacement parts
- Filters and consumables must meet the manufacturer's specifications for the installed model. Agua del Aire supplies original replacements and the one-year filter kit. Using parts that do not meet those specifications can affect the Equipment's operation and the water quality, and any resulting damage is not covered by the warranty.
- Maintenance record
- The Customer should keep a record of filter changes carried out. Agua del Aire may request it when handling a warranty claim.
- Documentation
- The equipment manual, with step-by-step maintenance procedures, is delivered with the unit in print and digital form.
- Consequence of non-compliance
- Failure to maintain the Equipment at the stated intervals, or the use of non-conforming parts, excludes the resulting damage from the limited warranty. Agua del Aire is not liable for changes in taste or odour, nor for mechanical compressor failures, attributable to neglected or non-conforming filtration.
4. Solar power and alternative energy
A. Engineering and inspection beforehand
- Mandatory assessment
- If the Equipment is powered wholly or partly from a photovoltaic system, a wind system or a battery bank, that system must be designed, rated and inspected by a licensed professional electrical engineer before the unit is connected.
- Proof of compliance
- Agua del Aire may request documentation evidencing that inspection before commissioning or before attending a service call on the unit.
B. Power stability and start-up surges
- Inverter sizing
- The Equipment's compressor draws a starting current considerably higher than its rated consumption. The inverter must be sized to absorb that surge without dropping voltage.
- Waveform quality
- Frequent voltage drops and square-wave output from low-grade or undersized inverters damage the control electronics and the compressor.
C. Exclusions
- Damage from the alternative installation
- Damage arising from a faulty solar installation, incorrect wire gauge, inverter failure, full battery-bank depletion, or unstable current from an off-grid or hybrid system is excluded from both the manufacturer's and the distributor's warranty.
- Runtime
- Agua del Aire is not liable for reduced water output resulting from insufficient solar harvest, cloudy weather, or storage limitations that shorten the Equipment's daily runtime.
- Solar systems in design
- Self-contained solar systems for the Altitude line are in the design stage. They are not finished products and are not available for sale, and nothing in this document should be read as an offer of them.
5. Sector-specific provisions
A. Residential use (T-12)
- Intended application
- Drinking water for a single-family home and domestic use.
- Owner's obligations
- The owner takes on the maintenance intervals in section 3 and the use of conforming replacement parts.
B. Commercial use (T-12, T-100)
- Intended application
- Offices, restaurants, gyms, hotels and commercial premises.
- Records and liability
- Commercial Customers must keep an internal maintenance log. Agua del Aire is not liable for interruptions to the Customer's business, loss of access to water, or the Customer's own breaches of any health regulations applicable to it, where these result from missed maintenance or the use of non-conforming parts.
C. Government and institutional use (T-100, T-200)
- Intended application
- Public buildings, disaster response and institutional infrastructure.
- Public procurement
- Purchases by Dominican State entities are governed by the public procurement rules in force and by any applicable State supplier registration requirements.
- Preventive maintenance
- Entities are advised to put a preventive maintenance contract in place with Agua del Aire covering the interventions in section 3.
6. Pricing, taxes and payment
- Currency
- Prices are quoted in Dominican pesos (DOP) or US dollars (USD), as stated in the quotation, invoice or contract.
- Taxes
- Prices are subject to applicable taxes, including ITBIS and any municipal duties, unless the Customer provides a valid exemption certificate.
- Invoicing
- Agua del Aire issues invoices with a valid fiscal receipt. A Customer buying in a company's name must provide its RNC at the time of quotation.
- Payment terms
- For commercial and government accounts, the payment schedule is set out in the purchase order or the relevant service agreement. Late payments accrue interest at the maximum commercial rate permitted under Dominican law.
7. Delivery, risk and installation
- Timelines
- Delivery timelines depend on model availability and on the Customer's location, and are confirmed in writing in the quotation.
- Transfer of risk
- Risk of loss passes to the Customer upon physical delivery of the Equipment at the designated site.
- Site preparation
- The Customer is responsible for ensuring the installation point meets the requirements for ambient air access, clearance around the unit, a dedicated outlet and surge protection.
- Placement
- Agua del Aire is not liable for output below the estimate where it results from placement other than the one recommended in the assessment, indoors without ventilation, or in air-conditioned spaces.
8. Warranty and limitation of liability
- Manufacturer's warranty
- The Equipment is covered by the Altitude Water limited warranty: one (1) year general cover on defects in materials and workmanship and, for the T-12, a further three (3) years on the compressor and coil. The exact terms are those in the manual for the unit actually installed, which prevails over any summary, this one included.
- Agua del Aire's role
- Agua del Aire acts as the authorised local service centre and handles claims, repairs and part replacements with the manufacturer.
- Exclusions
- The warranty does not cover filters or other consumables, nor damage from misuse, neglect, unauthorised tampering, the use of non-conforming parts, or extreme power or environmental anomalies.
- Limitation of liability
- To the maximum extent permitted by Dominican law, Agua del Aire's total liability on any claim shall not exceed the purchase price of the specific Equipment concerned. This limitation does not apply where Dominican law does not permit liability to be limited or excluded.
- No health claims
- Agua del Aire makes no medical or health claims about the water the Equipment produces. For any health question, the Customer should consult a qualified medical professional.
9. Governing law, language and disputes
- Governing law
- This Agreement is governed by and construed in accordance with the laws of the Dominican Republic, including any consumer protection rules applicable to the Customer.
- Language
- This document is published in Spanish and in English. In the event of any discrepancy between the two versions, the Spanish version prevails.
- Jurisdiction
- Disputes arising from this Agreement shall be submitted to the competent courts of the Dominican Republic. Nothing in this clause deprives a consumer Customer of the rights and forums Dominican law affords them.
- Amendments
- Agua del Aire may update these Terms. The version applicable to a transaction is the one in force on the date of that transaction; the last-updated date appears at the top of this document.
Stated output figures are site-specific estimates that depend on location, temperature and humidity; they do not constitute a production guarantee. Agua del Aire makes no medical or health claims about the water produced. For any health question, please consult a qualified medical professional.
